Section 1. General

This website is operated by Goldsome Studios. Throughout the site, “I”, “me” and “my” refer to Goldsome Studios.

By visiting the site and/ or purchasing something from Goldsome Studios, you engage in the “Service” and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Goldsome Studios has the right to change the Terms and Conditions and the content of the website at all times.

Section 2. Ordering

The agreement becomes binding once you place your order. Goldsome Studios will process your order after you have paid. Until then, Goldsome Studios will remain the owner of the product(s).

Because products are made after ordering, allow 10-20 business days of production time per item. 

Once your order is processed, you will receive an e-mail including the details of your order and confirming your payment has been accepted.

All descriptions of products or product pricing are subject to change at any time without notice. 

Goldsome Studios reserves the right to cancel any order you place.

Section 3. Prices

Prices are in euros and include VAT and exclude shipping fees. The shipping fee will be calculated at checkout.

Section 4. Payments

Payments are to be made through iDeal, debit or credit cards.

Section 5. Shipping

Goldsome Studios ships worldwide. The shipping fee and transit time will depend on your location.

Taxes and import duties may be applicable to your order. In no way is Goldsome Studios responsible for any customs, taxes or import costs.

Should the customer refuse the delivery or pickup of the order from the post office in order to avoid duties and taxes, the customer will be charged with a returning shipping fee and any taxes charged to Goldsome Studios.

Customers provide Goldsome Studios with the delivery address. If the delivery address is found to be incorrect or the customer is not at home when the courier has tried to deliver the package and there are therefore extra costs, the customer will be held responsible and additional costs may be charged to the customer. Goldsome Studios will not be responsible for undelivered or lost packages due to an incomplete address.

Section 6. Delivery period

Delivery times are indicative. Exceeding any delivery period does not entitle the customer to a compensation or claims.

Section 7. Returns and defective products

Customers have 14 days from the moment of arrival to return the item(s). The sealed package must be intact in order to return the items. If the seal has been broken, the items cannot be returned

The return shipping fee is on the buyer's account. The original shipping fee is non-refundable and is deducted from the refunded amount. Goldsome Studios is not responsible if the package, returning to the studio, is lost in transit. 

The refund will be transferred to the account where the original payment came from. 

Customers inspect the delivered products upon arrival and report any defects by e-mail within 14 days upon receiving the products. 

In the case of production errors, the item will be repaired or replaced.

Goldsome Studios has the right to decide what solution is most suitable. This may be a repair or replacement.

If Goldsome Studios repairs or replaces an item, this may take up to 20 working days, after the order arrived, unless otherwise communicated.

It is up to Goldsome Studios to decide whether or not there is a fabrication problem. 

By beginning a repair, the customer fully understands and agrees that he/she is responsible for the shipping and transit costs in both directions and the customer fully understand that there is no additional cost for the repair. Goldsome Studios does not hold any responsibility for jewelry until it arrives in the studio and is checked in as received by me, and I cannot be held responsible for any issues during transit. I will work my hardest to make sure your jewelry is returned back to you as quickly as possible, however I am not responsible for any lead time from any company for any reason whatsoever. 

Section 8. Liability

Goldsome Studios declines any responsibility in case of allergy to the materials of the jewelry.

Images and product descriptions are an indication. As each article is handcrafted and natural products are used,products may show slight variation. This may not be a reason to file a claim.

Goldsome Studios is not liable for damage caused by wear and/or tear.

Certain content, products and services available via my website or communications may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with Goldsome Studios. Goldsome Studios is not responsible for examining or evaluating the content or accuracy and Goldsome Studios do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

Goldsome Studios is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Goldsome Studios does not guarantee, represent or warrant that your use of my service will be uninterrupted, timely, secure or error-free.

Goldsome Studios does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time Goldsome Studios may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Goldsome Studios be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, my liability shall be limited to the maximum extent permitted by law. 

Section 9. User comments, feedback and other submissions

If, at Goldsome Studios’ request, you send certain specific submissions (for example contest entries) or, without a request from Goldsome Studios, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that Goldsome Studios may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to Goldsome Studios. Goldsome Studios is and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

Goldsome Studios may, but have no obligation to, monitor, edit or remove content that I determine in my sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead me or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. I take no responsibility and assume no liability for any comments posted by you or any third-party.

Section 10. Errors, inaccuracies and omissions

Occasionally there may be information on the website or communication that contains errors, inaccuracies or omissions, related, but not limited, to product descriptions, prices, promotions, offers, production time, shipping fees, transit time and availability. Goldsome Studios reserves the right to correct any errors, inaccuracies or omissions and to change and update the information or cancel the order if information applicable to the order at the time of purchase is incorrect.

Goldsome Studios is not liable for the consequences of unintentionally providing incorrect or incomplete information on the website or through other expressions.

Section 11. Complaints procedure

Goldsome Studios has a well-publicized complaints procedure and handles complaints in accordance with this complaints procedure.

Complaints about the implementation of the agreement must be fully and clearly described and submitted to Goldsome Studios within 2 months, after the consumer has discovered the defects.

Complaints submitted to Goldsome Studios will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Goldsome Studios will reply within 14 days with a confirmation of receipt and an indication when the consumer can expect a more detailed answer.

If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.

In case of complaints, a consumer must first turn to Goldsome Studios. It is also possible to register complaints via the European ODR platform. 

A complaint does not suspend Goldsome Studios’s obligations, unless Goldsome Studios indicates otherwise in writing.

If a complaint is found to be well-founded by Goldsome Studios, Goldsome Studios will replace or repair the products delivered free of charge at his choice.

Section 12. Disputes

Contracts between Goldsome Studios and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law. Even if the consumer lives abroad.

The Vienna Sales Convention does not apply.

Section 13. Copyright

All imagery and text by Goldsome Studios are copyrighted. Without written permission, it is not allowed to copy text and imagery from Goldsome Studios and reproduce or publicly use it in any way.

Section 14. Client's oblications

By accepting these general conditions, the customer declared to be of legal age according to the Dutch law or to hold a parental authorization to order on webshops.

The customer is also responsible for providing the correct personal information necessary for completing the transaction and the delivery of the order. Errors in personal data should be corrected by the customer, which can be done in the account section.
